Please review our terms and conditions for Peak Family Health membership plans and services.

Welcome to Peak Family Health PLLC. By enrolling in our membership plans or using our services, you agree to the following terms and conditions. Please read them carefully. If you do not agree with any part of these terms, do not proceed with enrollment or use our services.
1. Membership Plans
1.1. Commitment Period
- Memberships are flexible and designed to meet your needs. There is no minimum commitment period required for either the Silver or Platinum Plan. You may cancel at any time with a 30-day written notice.
1.2. Billing and Renewal
- Memberships are billed monthly unless otherwise specified during the signup process.
- Subscriptions will automatically renew on a monthly basis until a cancellation request is received and the 30-day notice period is completed.
1.3. Cancellation Policy
- Members may cancel their membership at any time by providing at least 30 days' written notice.
- Charges will continue to accrue during the 30-day notice period, and membership benefits will remain active throughout that time.
- To request cancellation, please contact us using our intake form.
- Cancellations received less than 30 days before the next billing cycle may result in one final monthly charge before cancellation is processed.
1.4. Refund Policy
- Membership fees are non-refundable, including for any unused services during the billing period.
- We encourage you to make full use of your benefits during the 30-day cancellation period.
2. Provider Access
2.1. Availability
- Access to providers is subject to availability and operating hours as stated on our website.
- Peak Family Health PLLC strives to provide consistent access to care tailored to patients' schedules, ensuring flexibility and convenience wherever possible. However, as a concierge practice serving multiple patients, appointment availability is not guaranteed, and some scheduling conflicts may occur.
- While we make every reasonable effort to accommodate your scheduling needs, we encourage patients to book appointments in advance to secure preferred times.
2.2. Scope of Services
- Services provided include telehealth visits, in-person consultations, annual wellness visits, and form completions, as outlined in your membership plan.
- Diagnostic testing, referrals, and additional services may incur separate fees.
2.3. Emergency Care
- Peak Family Health PLLC is not an emergency care provider. If you are experiencing a medical emergency, please call 911 or go to the nearest emergency room.
3. Payment Terms
3.1. Payment Obligations
- Members agree to provide accurate and up-to-date payment information upon enrollment and ensure timely payment of all membership fees.
3.2. Late Payments
- If a payment fails or is not received by the due date, membership access may be suspended until payment is received.
3.3. Failure to Pay
- Members who fail to pay their membership fees within 30 days of the due date may have their account referred to a collections agency.
- Failure to resolve unpaid balances may result in legal action, including collection efforts, and members will be responsible for any associated fees, including but not limited to collection agency fees, legal costs, and court fees.
4. Health Information and Privacy
4.1. HIPAA Compliance
- Peak Family Health PLLC adheres to the Health Insurance Portability and Accountability Act (HIPAA) to ensure the confidentiality and security of your medical records.
4.2. Data Collection
- By enrolling in our services, you consent to the collection and storage of your health information as required to provide services.
4.3. Third-Party Services
- Some services may involve third-party telehealth or diagnostic providers. Your data will only be shared with these providers as necessary for your care.
5. Member Responsibilities
5.1. Accurate Information
- Members are required to provide accurate and up-to-date personal and medical information during enrollment and throughout their membership.
5.2. Appropriate Use of Services
- Services provided through your membership are intended for the enrolled member(s) only. Misuse of services may result in termination of membership without a refund.
6. Disclaimers and Limitations of Liability
6.1. No Guarantee of Outcomes
- Peak Family Health PLLC does not guarantee specific health outcomes. Services are provided based on medical judgment and patient-provider collaboration.
6.2. Limitation of Liability
- Peak Family Health PLLC is not liable for indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the cost of the membership fee for the billing period in which an issue arises.
7. Changes to Terms and Conditions
Peak Family Health PLLC reserves the right to update these terms and conditions at any time. Members will be notified of significant changes via email and on our website.
8. Specialized Services Terms
8.1. Weight Loss Program
- Mandatory Monthly Appointments: Both weight loss-only members and standard members receiving weight loss care must attend mandatory monthly appointments. Failure to schedule and attend monthly appointments will result in restarting the weight loss journey from the beginning.
- Membership Distinctions: Weight loss-only members ($104/month + $50 registration fee) receive weight loss services exclusively and do not receive primary care membership benefits. Other medical care will be charged at non-member rates.
- Medication Costs: GLP-1 medications (Semaglutide and Tirzepatide) are prescribed separately and incur additional monthly fees ($195-375/month) based on dosage and medication type.
- Program Continuation: Weight loss programs require consistent participation. Extended gaps in care may require reassessment and potential program restart.
8.2. GI Mapping Services
- Telehealth-Only Service: All GI mapping consultations are conducted exclusively via telehealth. In-person visits are not available for this service.
- Four-Step Process: Service includes Initial Consult ($100), Lab Test Ordering (~$375 paid directly to Rupa Labs), Sample Collection period (approximately 2 weeks), and Follow-Up Visit ($150 members/$200 non-members).
- Lab Test Responsibility: Patients are responsible for lab test fees paid directly to Rupa Labs. Peak Family Health is not responsible for lab test costs or processing delays.
- Sequential Appointments: Follow-up appointments can only be scheduled after completion of initial consult and receipt of lab results. Scheduling restrictions apply.
8.3. Chronic Condition Management (Diabetes & Hypertension)
- Individual-Only Plans: Specialized diabetes and hypertension management plans ($170/month) are designed for individual patients only and do not include family coverage.
- Condition-Specific Care: These plans focus exclusively on the specified chronic condition. Other medical care will be charged at non-member rates.
- Regular Monitoring: Chronic condition management requires consistent monitoring and follow-up. Gaps in care may affect treatment continuity and outcomes.
- Medication Management: Prescription costs and medication monitoring are separate from membership fees and may incur additional charges.
8.4. Sports Physicals
- Fixed Pricing: Sports physicals are $150 for both members and non-members, providing comprehensive athletic clearance examinations.
- In-Person Requirement: Sports physicals must be conducted in-person to meet athletic participation requirements and ensure comprehensive evaluation. Telehealth options are not available.
- Form Completion: Service includes completion of required athletic participation forms as specified by schools or athletic organizations.
- Validity Period: Sports physical clearance is valid according to the requirements of the specific athletic organization or school. Renewal timing is the responsibility of the patient/guardian.
8.5. Service-Specific Disclaimers
- Treatment Outcomes: Specialized services do not guarantee specific health outcomes. Results may vary based on individual circumstances, compliance, and other factors.
- Provider Judgment: All specialized services are subject to provider medical judgment and may require modification based on individual patient needs and circumstances.
- Third-Party Services: Some specialized services may involve third-party providers (such as Rupa Labs for GI mapping). Peak Family Health is not responsible for third-party service delivery or costs.
9. Governing Law
These terms are governed by the laws of the State of North Carolina. Any disputes arising from these terms or the services provided will be subject to the jurisdiction of the courts in Mecklenburg County, North Carolina.
